Terms of Service

1. Acceptance of Terms
By creating an account or using The ARETE Program (“the Program”), you agree to be bound by these Terms of Service (“Terms”). These Terms constitute a legally binding agreement between you and Bill Bistak, RTP (“we”, “our”, or “us”), the creator and operator of the Program.
If you do not agree to these Terms, you must not access or use the Program.
2. Description of the Program
The ARETE Program is a self-directed, five-phase educational workbook designed to support individuals who have completed clinical sleep treatment and wish to continue improving their sleep through structured self-reflection and behavioural strategies.
The Program is provided for educational and self-improvement purposes only. It is not a medical service, clinical treatment, or therapeutic intervention.
3. Medical Disclaimer
The ARETE Program does not replace clinical care. Nothing in this Program constitutes medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider with any questions you may have regarding a medical condition, sleep disorder, or mental health concern. Never disregard professional medical advice or delay seeking it because of something you have read or completed in this Program.
4. Eligibility
You must be at least 18 years of age to use the Program. By using the Program, you represent and warrant that you meet this requirement and that all information you provide is accurate and complete.
5. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised use of your account. We are not liable for any loss or damage arising from your failure to protect your account information.
You may not share your account with others or use another person’s account without permission.
6. Acceptable Use
You agree not to:
- Use the Program for any unlawful purpose or in violation of these Terms.
- Attempt to gain unauthorised access to any part of the Program or its infrastructure.
- Reproduce, distribute, or commercially exploit any content from the Program without written permission.
- Upload or transmit any harmful, offensive, or disruptive content.
- Interfere with or disrupt the integrity or performance of the Program.
7. Intellectual Property
All content within the ARETE Program — including but not limited to the five-phase framework, workbook sections, exercises, text, and design — is the intellectual property of Bill Bistak, RTP and is protected by applicable copyright and intellectual property laws.
You are granted a limited, non-exclusive, non-transferable licence to access and use the Program for your personal, non-commercial use only. This licence does not include the right to reproduce, modify, distribute, or create derivative works from any Program content.
8. Listening Service
The Listening Service is an optional, application-based feature available to eligible program participants. Acceptance into the Listening Service is at our sole discretion. Participation does not create a therapeutic, clinical, or professional relationship of any kind.
Session bookings made through the Listening Service are subject to the scheduling and cancellation terms communicated at the time of booking.
9. Limitation of Liability
To the fullest extent permitted by law, Bill Bistak, RTP shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Program, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from these Terms or your use of the Program shall not exceed the amount you paid (if any) to access the Program in the twelve months preceding the claim.
10. Disclaimer of Warranties
The Program is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Program will be uninterrupted, error-free, or that any defects will be corrected.
11. Termination
We reserve the right to suspend or terminate your access to the Program at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our discretion.
You may delete your account at any time through the Account settings page.
12. Changes to These Terms
We may revise these Terms at any time. We will notify you of material changes by posting the updated Terms with a revised date. Your continued use of the Program after changes are posted constitutes your acceptance of the revised Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be resolved through good-faith negotiation before any formal legal proceedings.
